Trump’s Mail-in Ballot Restriction Rule Stands After Federal Judge Rejects Legal Challenge

A federal judge in Washington, D.C., has rejected a request from Democrats and their allies to block President Donald J. Trump’s executive order aimed at regulating mail-in voting.

The ruling follows an order signed by President Donald J. Trump in late March that requires the U.S. Postal Service to deliver ballots only to individuals listed as U.S. citizens on a federal voter registry compiled by the Department of Homeland Security and the Social Security Administration.

Shortly after the executive order was announced, various left-wing organizations vowed to challenge its implementation through federal courts. However, U.S. District Judge Carl Nichols recently dismissed their request for an injunction, stating that because the order had not yet been implemented, a temporary block would be unwarranted.

In his decision, Judge Nichols wrote: “The Court recognizes that the Postal Service may ultimately issue a final rule that directly affects Plaintiffs or their members, or that the Government may develop State Citizenship Lists that omit specific individuals due to particularized flaws… Plaintiffs may, of course, renew their motions if and when those future actions occur. Until then, however, Plaintiffs cannot show that preliminary injunctive relief is warranted.”

The ruling allows President Donald J. Trump’s executive order to remain in effect, potentially altering mail-in voting procedures during state primaries. The legal battle over election integrity will continue elsewhere, as a coalition of left-wing groups has filed a separate lawsuit in Boston, Massachusetts.

Additionally, the March executive order represents President Donald J. Trump’s second directive on election integrity. In 2025, he signed an executive order requiring proof of citizenship for voting registration—a measure that was blocked by courts despite growing concerns about illegal voting. Earlier this month, a federal judge also dismissed a request from Fulton County officials to return ballots seized by the Department of Justice during an investigation into alleged voter fraud in the 2020 presidential election.
